Terms of Sales

1. Our sales prices are given for information only, they can be reviewed, automatically on simple advice from us, in the following cases: price increase of raw materials; wage increases, exchange rate changes, following the revaluation of a foreign currency, for imported raw materials; increase in the cost of energy; lack of raw materials and replacement by other materials; change for reasons beyond our control, sources of supply, currency fluctuations. This list is not exhaustive. Certain sales prices may have been stipulated in a foreign currency, our prices are established on the basis of the prices of the day on the date of issue of our offer, and any change in them may result in a revision of the indicated prices.

2. All invoices are payable in cash.

3. Our delivery times are indicative. We are not responsible for any loss or damage resulting from any delay in delivery. Machine breakage, lack of force majeure or energy, strike, fire, flood, late deliveries by our suppliers etc. are considered as cases of force majeure. This list is not exhaustive.

4. The transport is done at the risk and peril of the buyer.

5. To be well-founded, any complaint concerning a shipment or billing must be filed within 8 days of the date of the consignment note / bill of lading / invoice. At the end of this term, our deliveries / invoices are supposed to be in accordance with juris and de iure. In case of non-compliant delivery our responsibility is limited to the replacement, in our usual delays, of the non-compliant supply. Other forms of compensation, whatever their cause may be, will not rest with the seller.

6. In case of dispute, only the courts have jurisdiction, either the Court of First Instance in Brussels or the Commercial Court in Brussels.

7. By an order, the buyer fully and completely accepts our conditions above. The conditions of sale mentioned above govern the contractual situation of the parties. Except other express and written agreements they are automatically applied. An attitude contrary to these general conditions of sale, even applied several times, does not entitle the buyer to apply it and does not imply a right granted on its behalf.
